Summary

The Board referred allegations that the Practitioner had contravened conditions to which his registration was subject. Specifically, the Board alleged that the Practitioner consulted an underage male patient without a chaperone present, failed to nominate an educator for one-one-one education and failed to provide the requisite compliance forms within the stipulated timeframes. The Board also alleged that the Practitioner failed to engage with Ahpra in relation to his non-compliance with the conditions.

The Panel found the allegations proven and that the Practitioner had engaged in unprofessional conduct under section 191(1)(b)(ii) of the National Law.

The Panel decided to reprimand the Practitioner and imposed additional conditions requiring that he be subject to mentoring in relation to ethical and professional conduct. In doing so it noted that despite ongoing communications and prompts, and multiple cautions by the Board in relation to non-compliance, the Practitioner continued to demonstrate a lack of insight, as well as effort to understand, the requirements of the conditions on his registration and a disregard for the seriousness of the imposition of conditions.

The Panel determined that the mentoring conditions would provide the Practitioner with guidance and an opportunity to gain a deeper understanding of his professional obligations, through one-on-one discussions with another colleague about regulation and compliance.

The Panel also determined that the current conditions on the Practitioner’s registration remain appropriate.
