Register of practitioners

If a health practitioner has the word "registered" in the column "registration status" they are registered and are legally able to practise within the scope of their registration. The exceptions to this are:

  1. practitioners who have a ‘non-practising’ status. 
  2. practitioners who have their registration suspended. 
  3. practitioners who have a condition on the registration which stops them from practising.

Registration expiry date

Under the National Law, practitioners remain registered while their registration renewal application is being processed. Practitioners may be correctly displayed as 'registered', but have a registration expiry date that has passed. The registration expiry date is adjusted as applications that meet the requirements of the National Law are processed.

Registration due?

Practitioners can check online whether their renewal application has been received. If Ahpra has received their application they can continue to practise within the scope of their registration while the application is processed.

Under the National Law, registrants are able to practise while their renewal application is being processed. Practitioners also remain registered for one month after their registration expiry date. If the practitioner's name appears on the Register, they are registered and can practise (excepting practitioners with a Registration Type of 'non-practising' or those with a condition which stops them from practising, or where their registration is suspended).

  • On 19 January 2021, the Queensland Office of the Health Ombudsman has taken immediate registration action by imposing the following conditions, under section 58 of the Health Ombudsman Act 2013 (‘the Act’), on the registration of Dr Anand Vardhan Bhatt (‘the practitioner’), a Chinese Medicine Practitioner in the State of Queensland under the Health Practitioner Regulation Nation Law (Queensland).

    Scope of practice

    1. The practitioner must not have contact with any patients under 18 years of age without the presence of a parent or guardian who is physically present during the consultation/treatment and directly observes the entire contact. A record of all persons present during the contact (including contact details) must be recorded in the patient’s treatment record.

    2. The practitioner must only practise as a registered health practitioner in employment and at practice location/s approved by the Health Ombudsman.

    3. The practitioner must take all reasonable steps to ensure patients under 18 years of age, or their parent or guardian, are told at the time of wanting to book an appointment with the practitioner that they can only do so if they comply with condition 1.

    4. The practitioner must keep a legible record of every appointment, including the name and age of each patient, and provide a full copy of the appointment records to the Office of the Health Ombudsman within five (5) business days of the end of each calendar month, unless otherwise directed by the Health Ombudsman.

    Practitioner acknowledgement

    5. Within three (3) business days of the commencement of these conditions, the practitioner must provide acknowledgement to the Office of the Health Ombudsman, by completing and submitting the Practitioner acknowledgement form, that they understand they must comply with the requirements of the age conditions as detailed in conditions 1-4.

    Booking requirements

    6. Unless otherwise directed by the Health Ombudsman, the practitioner must within three (3) business days of the imposition of these conditions AND prior to commencing in any new employment or practice location/s where health services are provided to patients under 18 years of age AND within three (3) business days of any new permanent, casual or temporary booking staff commencing at an approved practice location:
    a. complete and submit, on the Details of booking staff form, staff who will be responsible for making patient bookings where patients will be seen at any practice location
    b. provide an Acknowledgement of booking staff form from each nominated staff member, stating that they are aware that staff of the Office of the Health Ombudsman will contact them and exchange information.

    Employment conditions

    Current employment

    7. Within three (3) business days of the commencement of these conditions, if the practitioner is currently employed in a health service or providing a health service (practising) as a health practitioner the practitioner must obtain approval to continue practising at each practice location by submitting the following:
    a. a Request for approval of employment and practice locations form to advise the Office of the Health Ombudsman of the details of each practice location/s where the practitioner provides a health service (practises) as a health practitioner, and to formally seek approval from the Health Ombudsman to continue to practise at the practice location
    b. an Employer acknowledgement and consent form from any current employer, providing consent as detailed on the form, and certifying they have been provided with a copy of this Schedule of Conditions. If the practitioner is also the employer at any practice location and there is no other entity that meets the definition of employer, the practitioner must complete the form. Unless otherwise directed by the Health Ombudsman, a senior person at each practice location must also complete the form (see definitions for ‘employer’ and ‘senior person’ at the back of this Schedule of Conditions).

    New employment

    8. Prior to commencing in any new or other employment or practice location, in a health service or providing a health service (practising) as a health practitioner, the practitioner must complete and submit:
    a. a Request for approval of employment and practice locations form to advise the Office of the Health Ombudsman of the details of each practice location where the practitioner proposes to provide a health service (practise), and to formally seek approval from the Health Ombudsman to practise at the proposed practice location
    b. An Employer acknowledgement and consent form from any prospective employer, providing consent as detailed on the form, and certifying they have been provided with a copy of this Schedule of Conditions. If the practitioner is also the employer at the proposed place of employment, and there is no other entity that meets the definition of employer, the practitioner must complete the form. Unless otherwise directed by the Health Ombudsman, a senior person at each proposed practice location must also complete the form (see definitions for ‘employer’ and ‘senior person’ at the back of this Schedule of Conditions).

    Site Visit

    9. Within five (5) business days of the commencement of these conditions, the practitioner must provide written authorisation to the Office of the Health Ombudsman (the office) (by completing the Authority to conduct site visit form) for an authorised person(s) from the office to:
    a. Conduct site visits at the practitioner’s place(s) of practice. The purpose of such site visits includes, but is not limited to, the following:
    i. To confirm the practitioner's understanding of the requirements of these conditions.
    ii. To assess compliance with the requirements of these conditions.
    iii. To evaluate, observe and obtain in-depth information concerning the practitioner's implementation of the conditions in their place(s) of practice.
    iv. To verify and supplement the information contained in the log books, patient clinical records, appointment diaries, or any other information provided to the office showing the practitioner’s compliance with the conditions, and any information received from any other entity who may have provided information relevant to the practitioner’s professional practice.

    Other requirements

    General forms for submission

    10. Within five (5) business days of the commencement of these conditions (if the practitioner is the owner of a practice or entity that provides a health service) or within five (5) business days of becoming an owner of any practice or entity that provides a health service, the practitioner must provide written authorisation to the Office of the Health Ombudsman (by completing the Authority to access information form) to inspect, take or copy patient clinical records, log books and/or appointment diaries for any patient at such reasonable time or times as the Health Ombudsman shall determine for the purpose of monitoring compliance with the conditions imposed on the practitioner’s registration.

    11. Within five (5) business days of the commencement of these conditions, the practitioner must provide written authorisation to the Office of the Health Ombudsman (by completing the Authority to share information form) to exchange information with the practitioner’s employers and/or places of practice to ensure compliance with the conditions imposed on the practitioner’s registration.

    12. Within five (5) business days of the commencement of these conditions, the practitioner must provide written authorisation to the Office of the Health Ombudsman (by completing the Authority to release information form) to obtain the release of information relating to the provision of any health service by the practitioner from:
    a. Services Australia
    b. private health insurers
    c. any other entity who may provide information relevant to the practitioner’s professional practice and/or prescribing.

    Other matters

    13. Within five (5) business days of changing residential address, email address or contact telephone number, the practitioner must provide written notification to the Office of the Health Ombudsman of that change and provide new contact details.

    14. The practitioner must immediately advise the Office of the Health Ombudsman if at any time they are charged with an indictable offence.

    15. If, in the event of a medical emergency, the practitioner is unable to comply with a condition, any such incident must be notified to the Office of the Health Ombudsman within two (2) business days. For the purposes of these conditions, a medical emergency is an incident where it is not possible or reasonable to have a patient with a serious or life-threatening condition seen by another practitioner or transferred to the nearest hospital.

    Costs

    16. All costs associated with compliance with these conditions are at the practitioner’s own expense.

    Period of conditions

    17. The imposition of the conditions will commence on the day this notice is served on you, pursuant to section 62(1) of the Act.

    18. Pursuant to section 62(2) of the Act, the decision to take immediate registration action continues to have effect until the earlier of the following happens:
    a. the Queensland Civil and Administrative Tribunal (the QCAT) sets aside the decision -
    i. on application by the practitioner for a review of the decision; or
    ii. on referral of the matter to the QCAT by the Director of Proceedings on the Health Ombudsman’s behalf; or
    b. the Health Ombudsman removes the conditions under section 65 of the Act.

    Definitions

    ‘Communication device’ is defined as any hardware that transmits voice, video or text including those that transmit information via electronic booking applications.

    ‘Contact’ with a patient includes consultation, interview, examination, assessment, advising, or otherwise treating a patient, whether it is in person or on a communication device.

    ‘Employer’ is defined as an entity that-
    (a) employs the practitioner to provide health services; or
    (b) engages the practitioner to provide health services under a contract for services; or
    (c) operates a facility at which the practitioner provides health services; or
    (d) the practitioner is providing services to or on behalf of, whether in an honorary capacity, as a volunteer or otherwise, and whether or not the practitioner receives payment from the entity for the services.

    ‘Employer’ therefore also includes co-owners, co-directors, contractors of service, and/or owners/operators of medical practices, hospitals and/or facilities where the practitioner provides a health service (even if there is no contractual relationship between the practitioner and the owner/operator).

    ‘Health practitioner’ is defined under the Health Ombudsman Act 2013 as an individual who is -
    (i) a health practitioner under the National Law; or
    (ii) another individual who provides a health service.

    ‘Health service’ is defined as a service that is or purports to be for maintaining, improving, restoring or managing people’s health and wellbeing, and includes a ‘support service’ for a health service. For a full definition of ‘health service’, please see section 7 of the Health Ombudsman Act 2013.

    ‘Patient’ is defined as:
    (a) any individual awaiting, requiring, or receiving the professional services of an unregistered or registered health practitioner; and
    (b) any spouse, partner, parent, family member or guardian/carer of this individual, who accompanies the individual at the time of consultation with the practitioner and requests the professional services of the practitioner.

    ‘Practice location’ means any location where the practitioner provides a health service including any place where the practitioner:
    (a) is self-employed
    (b) shares premises with other registered or unregistered health practitioners
    (c) is engaged by one or more entities under a contract of employment, contract for services or any other arrangement or agreement
    (d) provides services for or on the behalf of one or more entities, whether in an honorary capacity, as a volunteer or otherwise, whether or not the practitioner receives payment from an entity for the services, or
    (e) provides professional services at the residential premises of a patient.

    ‘Practise’ is defined as any role, whether remunerated or not, in which a practitioner uses their skills and knowledge in a health care industry, whether they are required to be a registered health practitioner or not. It is not restricted to the provision of direct clinical care and includes using the knowledge and skills of any health practitioner in a direct non-clinical relationship with a patient or client, working in management, administration, education, research, advisory, regulatory or policy development roles and any other roles that impact on safe, effective delivery of services in the health care industry.

    ‘Senior person’ is defined as a person at the place of practice where the practitioner is providing a health service such as the Director of Medical Services, Director of Nursing, Senior Practice Manager, Senior Manager, Senior Partner, Proprietor, Owner, or equivalent.

    ‘Support service’ for a health service, means a service providing business support, clinical support, corporate support or other support to the health service. See schedule 1 of the Health Ombudsman Act 2013 for examples of a support service.
